Rate parity clauses: can you offer a lower price on your own site than on Booking?

What rate parity means, what has changed legally in the EU, and how to reward guests who book direct without breaking your contract.

You pay Booking a commission on every room it sells, and you wonder why you can't match, or beat, that price on your own website. The answer is usually buried in a clause in your OTA (online travel agency) contract: the rate parity clause.

The good news is that the landscape has shifted a lot in Europe, and even where restrictions still apply, you have perfectly legal levers to make direct booking more attractive. In this article I explain what parity is, what has changed recently, and, most importantly, what you can do this week so guests book straight from you instead of through commission.

What a rate parity clause actually is

Rate parity is a clause where the OTA asks you not to display a better price anywhere else than with them. There are two forms, and the difference matters enormously:

  • "Wide" parity: you may not be cheaper on your own site or on other OTAs. The most restrictive kind.
  • "Narrow" parity: the OTA only asks that you don't publicly display a lower price on your own site, but leaves you free on other channels and on "closed" rates.

The key word is "public". Almost every version of parity targets the price shown to anyone who lands on your site. Rates offered to a closed group, to logged-in members, or bundles that can't be compared directly generally fall outside the clause.

What has changed: legal pressure on parity

In recent years the direction across the European Union has been clear: parity clauses have been put under serious scrutiny. Several European countries banned the wide forms, a 2024 ruling by the Court of Justice of the EU weakened their legal defence, and the Digital Markets Act forced large platforms to drop them.

That doesn't mean you can ignore the contract you signed. The practical reality:

  • The clause that matters for you is the one in YOUR contract, not the headline in the press.
  • Read exactly what you signed before you cut the public price.
  • For large sums or old contracts, an hour with a specialist lawyer saves you from surprises.

The trend is in your favour, but the final call should be one you make informed, not from hearsay.

How to offer more on your site without breaking anything

Even with a parity clause in place, you have a whole list of legal levers to make direct booking beat the OTA:

  • Direct perks, not a lower price: breakfast included, late check-out, a room upgrade when possible, free parking, a welcome drink. These are added value, not a displayed rate.
  • Member rates: a special price visible only after the guest logs in or joins a closed group. These rates have almost always sat outside parity clauses.
  • Bundled packages: room + dinner + a local experience. A package isn't a like-for-like comparison with a bare room on Booking.
  • Better policies: longer free cancellation, more flexibility on changes.

The message to the guest is simple: "Your best price and best conditions are when you book direct."

Why commission gives you a real edge

This is the part many owners miss. Every OTA booking leaves with a hefty commission out of your pocket. When the guest books direct, that money stays with you.

That gives you room to move: even offering a breakfast or a member discount, you can net more than from an OTA booking at the "list" price. In practice you're not competing with Booking on gross price, but on how much lands in your account after commission.

That's why the direct channel isn't just a matter of pride, it's a matter of margin. Every guest won back from the OTA is a room sold more profitably at the same occupancy. Over time, that's the difference between a hotel that barely covers costs and one that grows.

You need a direct channel that actually converts

None of the levers above matter if the guest lands on a slow site that looks bad on a phone and where they can't book in a few seconds. Then they go back, resigned, to Booking.

A direct channel that works needs:

  • A fast site, clear on mobile, with prices and direct perks in plain sight.
  • A simple way to book or request a room: a booking engine or, at the start, at least a WhatsApp button that goes straight to you.
  • A visible reason to book direct, exactly the ones discussed above.

"Wide" forbids you from being cheaper anywhere, including on other OTAs. "Narrow" only restricts the public price on your own site relative to that OTA, but leaves you free on closed rates and other channels. The wide forms are the most legally contested.

Can I offer lower rates only to members or a closed group?+

Generally yes. Rates visible only after login or inside a closed group aren't a "public price" and have almost always sat outside parity clauses. It's the safest lever to reward the direct guest.

Do I need a full booking engine or is WhatsApp enough to start?+
